There is a wildly held assumption that by using subcontractors a business is also outsourcing the risks associated with that work as well as the work itself. This is of course not true.

The business engaging the contractor retains duties under health and safety law and must take reasonable steps to ensure contractors are competent and work safely.

Before appointing a contractor, ask the crucial questions: What experience do they have? Can they provide risk assessments and method statements? How do they manage training, supervision and insurance? What is their accident history? How will they communicate hazards on site? Who is responsible for welfare and first aid? How will the work be monitored and reviewed?

Getting clear answers to these questions helps you select the right partner and keep people safe.
